Platform rules, clearly explained.

Welcome to Tuktix ("Platform", "App", "Website", "we", "our", or "us"). Tuktix is a technology-based ride facilitation platform that connects passengers ("Users") with independent ride service providers including bike taxi operators, auto-rickshaw drivers, and cab drivers ("Captains"). By accessing or using the Tuktix platform, you agree to comply with and be legally bound by these Terms and Conditions.

1. Definitions

  • "Platform" refers to the Tuktix mobile application, website, APIs, software, and related services.
  • "User" refers to a passenger who books transportation services through the Platform.
  • "Captain" refers to an independent third-party transportation provider registered on the Platform.
  • "Ride" refers to transportation service facilitated through the Platform.

2. Eligibility

  • Users must be at least 18 years old and legally capable of entering into binding agreements.
  • All registration information provided must be accurate and current.

3. Role of Tuktix

  • Tuktix acts solely as a technology intermediary platform.
  • Tuktix does not own transportation vehicles or employ Captains.
  • Captains independently provide transportation services.

4. User Account

  • Users may be required to register with mobile number or email.
  • Users are responsible for maintaining account confidentiality and security.

5. Captain Account

  • Captains must maintain valid licenses, permits, insurance, and vehicle documents.
  • Tuktix reserves the right to suspend or terminate Captain accounts for violations.

6. Booking and Rides

  • Ride requests are subject to Captain availability.
  • Estimated fares and arrival times are approximate and may vary.

7. Pricing and Payments

  • Ride fares may include distance charges, waiting charges, tolls, taxes, and platform fees.
  • Payments may be processed via Razorpay or other third-party payment gateways.
  • Refunds are subject to review and applicable policies.

8. Cancellation Policy

  • Cancellation charges may apply after ride acceptance.
  • Repeated cancellations by Captains may lead to penalties or suspension.

9. User Responsibilities

  • Users shall not misuse the platform, harass Captains, or engage in unlawful activities.
  • Users are responsible for belongings carried during rides.

10. Captain Responsibilities

  • Captains must comply with traffic laws and maintain professional conduct.
  • Captains shall ensure vehicle cleanliness and passenger safety.

11. Safety Disclaimer

Tuktix makes reasonable efforts to improve safety but cannot guarantee uninterrupted or risk-free services.

12. GPS and Location Services

The platform uses GPS and location services for ride matching, navigation, and safety.

13. Intellectual Property

All platform content, branding, and software remain the property of Tuktix.

14. Third-Party Services

Tuktix may integrate with third-party providers including Razorpay and Google Maps.

15. Limitation of Liability

Tuktix shall not be liable for accidents, delays, misconduct, payment failures, or indirect damages.

16. Indemnification

Users and Captains agree to indemnify Tuktix against claims arising from misuse or violations.

17. Termination

Tuktix reserves the right to suspend or terminate accounts for fraud, abuse, or legal violations.

18. Governing Law

These Terms are governed by the laws of India.

19. Modifications

Tuktix may modify these Terms at any time. Continued use constitutes acceptance.
